Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and CrispVoice ("we", "us"). By installing or using the CrispVoice iPhone app (the "App"), you accept these Terms. If you don't accept them, don't install or use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, in accordance with these Terms and Apple's Standard EULA, which applies in addition to these Terms.

2. Subscription & billing

CrispVoice Pro is sold as an auto-renewing subscription via the App Store. The following terms apply, in compliance with App Store guideline 3.1.2:

• Title: CrispVoice Pro.
• Length of subscription: 1 month or 1 year, depending on the plan you select.
• Price: US$4.99 / month or US$39.99 / year (or the equivalent in your local currency, as displayed at purchase).
• Auto-renewal: Subscriptions renew automatically at the same price and term until canceled. Your Apple ID is charged for renewal within 24 hours of the current period ending.
• Cancellation: Cancel at least 24 hours before the period ends to avoid renewal. Manage subscriptions at Settings → [your name] → Subscriptions, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current paid period; you keep Pro access until then.
• Refunds: Handled by Apple per the App Store terms. Visit reportaproblem.apple.com.
• Functional links: these Terms and the Privacy Policy are accessible from inside the App and from this website.
• Restore Purchases: available from the App's paywall on every device signed into the same Apple ID.

3. Free tier & trials

The free tier of CrispVoice is available indefinitely with the feature set described on the pricing page. We may offer a free trial of Pro from time to time; if a trial is in effect when you subscribe, the renewal date and charge schedule will be disclosed at purchase. Any unused portion of a free trial is forfeited when you purchase a paid subscription, in accordance with App Store rules.

4. Your content

You retain all rights to recordings, transcripts, and exported files you create using CrispVoice ("Your Content"). CrispVoice does not store, transmit, or claim any license to Your Content — it remains on your device and is yours to use, share, or delete. You are solely responsible for ensuring you have the right to record, edit, and distribute Your Content.

5. Acceptable use

You agree not to use the App to:

• Record any person without their consent where consent is required by law in your jurisdiction.
• Infringe any third party's copyright, privacy, publicity, or other rights.
• Reverse-engineer, decompile, or attempt to extract proprietary algorithms, except where Apple's EULA expressly permits.
• Circumvent the App Store payment system or any technical protection measures in the App.

6. Third-party services

The App relies on Apple frameworks (StoreKit, AVFoundation, Speech framework, Apple Intelligence Speech Analyzer where available). Your use of those frameworks is also governed by Apple's terms. We are not responsible for the availability or behavior of Apple services.

7. Disclaimers

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be error-free, uninterrupted, or that any specific result will be achieved by using it.

8. Limitation of liability

To the maximum extent permitted by law, in no event will CrispVoice, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App. Our total cumulative liability arising out of or relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months preceding the claim, or (b) US$50.

9. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms. Termination doesn't affect any rights or obligations that accrued before termination, including any obligation to pay fees already incurred.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged in-app on next launch. Your continued use of the App after the effective date of the updated Terms constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, except where consumer protection laws of your jurisdiction require otherwise.

12. Apple-specific terms

If you obtained the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and us only — Apple is not a party.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• We, not Apple, are responsible for product liability claims, claims that the App doesn't conform to applicable legal or regulatory requirements, and consumer protection / privacy claims relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
